To the one who asked about whether smoking in the elevators is deemed illegal by RA 9211, otherwise known as the 'Tobacco Regulation Act of 2003,' the answer is, I am not quite sure; not even on residential building hallways. There is no provision for residential buildings at all.

I think, in its creation, the residential buildings were left out because it is perhaps assumed that the corporation (trustes) in charge of whatever residential complex will draft such ruling in their respective bylaws, with appropriate penalties.
Let's work on that if it isn't there. I personally want it there, the Admin has noted this in the last meeting with the fire investigator, SPO2 Alde.
Still, common sense dictates, there shouldn't be smokers in those confined areas, since the prescription enlists 'small enclosed public places.'
But where will we put them smokers? I have no idea at the moment, because, honestly, wherever they are assigned within the compound cannot qualify as a designated area. There is no way we can comply to the required 'three basketball court distance ' from any person below 18 years old within our community. Anywhere a person is standing, 18 year-old up or younger, will always be below three basketball court distance in length and in width. So...
SMOKE AT HOME. Or at night, when this requirement can be complied with, because the minors are asleep.
There is also QC City Ordinance, which I have yet to get hold a copy of. But in a nutshell, it prohibits smoking in public places and in public conveyances... like an elevator?
I do not know the penalties of the Ordinance. Maybe we can ask the Quezon City Smoke-Free Task Force Mayor Herbert Bautista created last year.
For whatever else, maybe it is high time to lobby an update to the existing city ordinance to specifically include a protection by law within the privacy of our compound. Through this, the residents can have civil power to punish the violator.
If only we can arm the guards with partial police power, maybe there will be less pasaway folks...
Of course, as soon as there becomes a resolution made by the current board, you can all expect permanent postings and warnings with penalties indicated, on the designated warning areas, as prescribed by the LAW.
Wish there is security cam in the chute areas and elevators. If there are security cams i these parts of the community, that's one less security and safety issue to deal with...
Last, please pass the announcement on the meeting on Sunday, Clubhouse, 2 onwards. We need suggestions, if not just physical agreement to some suggestions that will arise on that day.
